Privacy policy

This English version is a translation for your convenience. In case of any difference, the Dutch version prevails.

FreVyDesigns attaches great importance to the protection of your personal data. In this privacy policy we explain which personal data we collect, why we process it, how long we keep it and what rights you have.

Hereinafter referred to as “FreVyDesigns”, “we” or “us”.

2. Which personal data do we process?

Depending on your contact with FreVyDesigns, we may process the following data, among others:

  • surname and first name;
  • address;
  • e-mail address;
  • telephone number;
  • billing and delivery details;
  • company and VAT details, where applicable;
  • information about your order or custom assignment;
  • information you provide when requesting a quote;
  • photos, images, logos or other files you supply yourself;
  • communication between you and FreVyDesigns;
  • payment information insofar as necessary to process payments;
  • technical data about the use of our website, such as IP address, browser and device, insofar as these are collected through cookies or similar technologies.

We only collect data that is reasonably necessary for the purposes for which it is processed.

3. What do we use your data for?

We may process personal data for the following purposes:

Carrying out assignments

To draw up quotes, process orders, design and paint custom helmets, make appointments and carry out the assignment.

Communication

To contact you in response to a question, quote request, order or assignment.

Invoicing and administration

To process payments, draw up invoices and meet our statutory accounting and administrative obligations.

Delivery and shipping

To be able to send or return a helmet or other product correctly.

Website improvement

To analyse and improve our website and services, insofar as there is a valid legal basis for doing so.

Marketing

If you have given your consent, or if we can rely on another legal basis, we may inform you about our services, new projects or other relevant communication.

You can unsubscribe from commercial communication at any time.

Portfolio and social media

We may use photos of finished custom helmets for our portfolio, our website and social media.

If a photo contains personal data or if you are reasonably recognisable, we will take the applicable privacy rules into account and ask for your consent where required.

4. Legal basis for processing

We only process personal data when there is a valid legal basis for doing so.

This may include:

  • the performance of an agreement;
  • taking steps at the client’s request before entering into an agreement;
  • compliance with a legal obligation;
  • our legitimate interest;
  • your consent.

When processing is based on consent, you can withdraw that consent at any time.

Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal.

5. Payments

When you make a payment, external payment service providers may be used for this.

Depending on the payment method chosen, personal data may be processed directly by the payment service provider concerned.

FreVyDesigns has no access to the data that the payment service provider itself needs to process a payment, except insofar as this data is provided to us, for example the payment result or a payment reference.

6. Sharing with third parties

We do not sell your personal data.

We may, however, share personal data with service providers when this is necessary for our business operations, for example:

  • hosting providers;
  • IT and software suppliers;
  • accounting service providers;
  • payment service providers;
  • transport and shipping services;
  • professional advisers;
  • other service providers necessary for the performance of our agreement.

These parties may only process your data within the scope for which they have been engaged and in accordance with the applicable legislation.

Where required by law, we make appropriate data protection agreements with processors.

7. Retention period

We do not keep personal data longer than necessary for the purposes for which it is processed.

Some data must be kept longer because we are legally obliged to do so, for example data that forms part of our accounting or administration.

After the applicable retention period, data is deleted or anonymised, unless longer retention is necessary because of a legal obligation or a legal dispute.

8. Security

We take appropriate technical and organisational measures to protect personal data against loss, unauthorised access, alteration or disclosure.

However, no method of storage or electronic transmission can be fully guaranteed against all risks.

9. Your rights

Under the conditions of the applicable privacy legislation, you have the right, among other things, to:

  • request access to your personal data;
  • have incorrect personal data corrected;
  • have your personal data deleted in certain circumstances;
  • have processing restricted in certain circumstances;
  • object to certain processing;
  • withdraw your consent where processing is based on it;
  • have your data transferred in certain circumstances;
  • lodge a complaint with the competent supervisory authority.

To protect your personal data, we may ask you to provide sufficient information to verify your identity when you request access or changes.

10. Complaints

If you believe that we are not processing your personal data correctly, you can first contact us so that we can look into the problem.
