Custom Helmet Policy

This English version is a translation for your convenience. In case of any difference, the Dutch version prevails.

At FreVyDesigns, every custom helmet is finished by hand according to a specific design. Because every assignment is unique, the specific conditions below apply to custom helmet projects in addition to our general terms and conditions.

1. A custom helmet is bespoke work

A custom helmet project is designed and made specifically according to the client’s wishes.

The final result can therefore not always be exactly identical to a digital image, photo, reference or previous helmet.

Small differences in colour, texture, brushwork, line work, gloss, position or finish are inherent to handwork and do not automatically constitute a defect.

2. The design

Before the work starts, FreVyDesigns may provide a digital design, sketch or mock-up.

The client is given the opportunity to check this design.

As soon as the client has approved the design, FreVyDesigns can start the work.

Approval means that the client agrees with the overall composition, colours, texts, logos and other agreed elements.

3. Changes after approval

Changes after a design has been approved may involve extra costs.

This applies in particular when:

  • preparation has already started;
  • materials have already been purchased;
  • parts have already been painted;
  • the design has to be prepared again;
  • extra working hours are required.

Where reasonably possible, FreVyDesigns will inform the client in advance of any additional costs.

4. Supplied helmets

When the client supplies a helmet, it must:

  • be the property of the client or be lawfully usable by the client;
  • be sufficiently clean;
  • be free of personal items;
  • be supplied together with all necessary parts, unless agreed otherwise.

The client must report existing damage or earlier repairs in advance.

5. Condition of the helmet

Before the work starts, FreVyDesigns may take photos of the helmet received.

These photos may be used to record the original condition of the helmet.

Existing:

  • scratches;
  • dents;
  • cracks;
  • discolouration;
  • damage;
  • repairs;
  • wear;
  • paint problems;
  • other defects

are not the responsibility of FreVyDesigns.

If hidden problems are discovered during preparation, FreVyDesigns may temporarily suspend the work and contact the client.

6. Suitability of the helmet

Not every helmet is suitable for customising.

FreVyDesigns reserves the right to refuse a helmet when, for example:

  • the construction is damaged;
  • the helmet is severely worn;
  • the existing coating may cause problems;
  • the helmet cannot be treated safely;
  • the desired treatment involves an unacceptable risk of damage.

Where possible, FreVyDesigns will inform the client of this before any work is carried out.

7. Safety and homologation

FreVyDesigns specialises in the cosmetic and artistic customisation of helmets.

The work of FreVyDesigns does not constitute a safety inspection, homologation, certification or structural repair of a helmet.

FreVyDesigns does not guarantee that, after customisation, a helmet:

  • meets a particular safety standard;
  • meets a specific homologation;
  • is suitable for a particular racing class;
  • is suitable for use on public roads;
  • retains its original safety characteristics if the helmet was already damaged or unsuitable before the treatment.

The client remains responsible for checking the suitability of the helmet for its intended use.

If in doubt about the safety of a helmet, the client should contact the manufacturer or a qualified expert.

8. No structural modifications

Unless expressly agreed otherwise in writing, FreVyDesigns only carries out cosmetic work.

No structural modifications are made to the helmet.

Removing, drilling, cutting, adapting or modifying structural parts is not part of a standard custom paint assignment.

9. Responsibility of the client

The client remains responsible for:

  • the correct use of the helmet;
  • following the manufacturer’s instructions;
  • checking the suitability of the helmet;
  • replacing the helmet in good time when the manufacturer states that it must be replaced;
  • damage arising after delivery.

A custom paint job does not change the client’s responsibility to use the helmet safely and in accordance with the manufacturer’s instructions.

10. Maintenance of a custom helmet

A custom painted helmet must be handled with care.

We recommend using only soft materials and products that are suitable for the finish concerned.

Do not use:

  • aggressive chemicals;
  • solvents;
  • abrasive cleaning agents;
  • scouring pads;
  • products of which it is not known whether they are suitable for the finish.

Damage caused by incorrect maintenance, aggressive cleaning products or incorrect use is not the responsibility of FreVyDesigns.

11. Normal signs of use

A custom helmet is an object made to be used.

Small scratches, wear, stone chips, signs of use and other damage arising during normal use may occur over time.

Such normal signs of use do not constitute a defect in the paintwork carried out.

12. Drying and curing time

After painting and lacquering, a certain drying and/or curing time may be necessary.

The helmet may only be used once FreVyDesigns indicates that the finish has cured sufficiently for normal use.

Using, cleaning, packing or handling the helmet prematurely may damage the finish.

Damage resulting from this is not the responsibility of FreVyDesigns.

13. Delivery of the helmet

The client is responsible for sending his or her own helmet safely to FreVyDesigns, unless other arrangements have been made in advance.

We advise using sturdy packaging and sufficient protective material.

On receipt, the helmet is checked and photographed where possible.

14. Return shipment

When the finished helmet is sent to the client, it is packed carefully.

Any damage demonstrably caused during transport is dealt with in accordance with the applicable statutory rules and the carrier’s conditions.

15. Ownership of the design

The creative designs, sketches, illustrations, digital mock-ups and other creative works made by FreVyDesigns remain protected by the applicable intellectual property rights.

After full payment, the client obtains the use of the finished physical product.

The design may not be copied, reproduced or commercially exploited without prior permission.

16. Logos and images from the client

When the client supplies a logo, image, photo, trademark or other protected material, the client declares that he or she is entitled to have this material used for the assignment.

The client is responsible for any permission required from rights holders.

FreVyDesigns may refuse an assignment if the use of the supplied material may infringe the rights of third parties.

17. Portfolio

FreVyDesigns may take photos of finished custom helmets for documentation and portfolio purposes.

Unless the client objects in writing in advance, such photos may be used on:

  • www.frevydesigns.com;
  • social media;
  • portfolios;
  • marketing material;
  • advertisements;
  • printed matter.

If the client indicates in advance that the project must remain confidential, FreVyDesigns will take this into account.

18. Cancellation

Because custom helmets are prepared and made specifically for the client, cancellation after the assignment has started may incur costs.

In the event of cancellation, FreVyDesigns may charge for the work already carried out, the materials purchased and the costs reasonably incurred, insofar as the law permits.

If the helmet has already been prepared or painted, it may not be possible to restore it fully to its original condition.

19. Personalised products and right of withdrawal

Custom helmets are generally designed and made specifically according to the client’s wishes.

For goods made to the consumer’s specifications or clearly intended for a specific person, the statutory right of withdrawal may not apply.

Where this statutory exception applies, the client is informed of this before the agreement is concluded.

Statutory consumer rights always remain applicable insofar as they cannot validly be excluded.

20. Complaints about the final result

If the client believes that the result delivered does not correspond to what was agreed, he or she must contact FreVyDesigns as soon as possible.

When making a complaint, please:

  • state the order or quote number;
  • describe the problem clearly;
  • add photos of the helmet;
  • add photos of the original design, if relevant.

FreVyDesigns will assess the complaint and, if there is an error for which FreVyDesigns is responsible, look for an appropriate solution.

21. Repairs and touch-ups

If a touch-up or repair is necessary as a result of an error by FreVyDesigns, it will be carried out in consultation with the client.

Damage arising after delivery from use, transport, accidents, impact, cleaning, maintenance or other external circumstances is not automatically eligible for a free touch-up.

22. Agreement

By placing a custom helmet order, the client declares to have read this Custom Helmet Policy and to agree to it.

This policy supplements the general terms and conditions of FreVyDesigns.

In the event of a conflict between this policy and the general terms and conditions, the provision relating specifically to custom helmet assignments applies, insofar as the law permits.
